DA to Challenge Employment Equity Act Quotas in Court

The Democratic Alliance (DA) has filed a legal challenge against Section 15A of the Employment Equity Amendment Act (EEAA), arguing that the clause unfairly enforces race-based employment quotas and violates constitutional principles.

The contested provision empowers the Minister of Employment and Labour to set sector-specific racial targets and penalize companies that fail to comply, including barring them from state contracts. The DA claims this approach is counterproductive, discouraging investment and skills retention.

This law is the epitome of racial division. South Africa needs policies that create jobs for all South Africans, not rigid quotas that undermine merit and growth.

The Department of Employment and Labour maintains that Section 15A is necessary to accelerate workplace transformation, aligning with broader efforts to redress apartheid-era inequalities.

The case is expected to be heard in the High Court soon, with business groups and labour unions closely watching the outcome.
