The National Prosecuting Authority has decided not to prosecute a 58-year-old man arrested in connection with a fatal road rage shooting that occurred on Sunday in Emmarentia, Johannesburg.
The decision was confirmed at the Johannesburg magistrate’s court, where the suspect had been expected to appear. Instead, the court was informed that the chief prosecutor determined the evidence currently available is insufficient to proceed with the case.
The incident began when two male drivers engaged in a physical altercation following a road rage dispute, reportedly involving one car attempting to overtake another. A female passenger, suspected to be the wife of one of the drivers, retrieved a firearm from the car. The second driver also allegedly pulled out his own weapon.
Gunfire ensued, claiming the life of one husband. The other driver sustained minor injuries, and the deceased’s wife was taken to hospital with a gunshot wound.
The 58-year-old had been arrested on charges of murder and attempted murder.
Speaking outside the court, NPA spokesperson Magaboke Mohlatlole explained the decision: “After the careful consideration of the evidence in the alleged incident which occurred in Emmarentia, the NPA decided not to proceed with the case pending further investigations.”
When asked why the decision was taken, Mohlatlole added: “The matter will be placed at some later stage when we have sufficient evidence to place it on record.”
The reporter, reporting from the scene, noted that investigators had been looking into whether the deceased’s wife provoked the incident by fetching the firearm. However, authorities were unaware at the time that the 58-year-old also possessed a gun, which he drew and fired multiple times.
The NPA has clarified that the decision not to prosecute at this stage does not mean the case is dropped. Further investigation is required to determine exactly what occurred and who was at fault.
The deceased’s wife remains in hospital. Police have previously indicated they were not ruling out the possibility of additional arrests, depending on evidence presented to the senior public prosecutor.
