IEC Welcomes Court’s Not Guilty Verdict in Voting Materials Case

The Pietermaritzburg Magistrate’s Court has acquitted IEC area manager Musawenkosi Mnikathi, ending a lengthy trial where he faced charges related to the movement of voting materials between polling stations. The National Prosecuting Authority (NPA) had pursued the case, alleging improper handling of electoral materials.

The Independent Electoral Commission (IEC) expressed relief at the verdict, with CEO Sy Mamabolo stating that Mnikathi had acted within his authority. “We’ve always believed Mr. Mnikathi operated within the scope of his employment,” Mamabolo said. “Section 91 of the Electoral Act empowers the CEO—and by extension, presiding officers—to relocate materials to ensure smooth voting processes.”

The case had raised concerns about misunderstandings of electoral laws, particularly among newer political parties and independent candidates. Mamabolo acknowledged the need for better voter education, stating, “We must intensify efforts to clarify the Electoral Act’s provisions through training and manuals.” However, he confirmed that the ruling does not necessitate legal amendments, only clearer guidance from the IEC.

The acquittal lifts what the IEC called a “dark cloud” over the commission and Mnikathi, who was arrested during the investigation. The IEC now plans to focus on improving stakeholder understanding of electoral procedures ahead of future elections.
