Educator Sentenced for Failing to Report Rape of Minor

The South African Police Service has welcomed the sentencing of a 44-year-old female teacher who was found guilty of failing to report the statutory rape of an 11-year-old girl. The sentencing, handed down in the Bloemfontein Magistrate’s Court, underscores the legal accountability of mandated reporters who choose silence over protecting a child.

The case originated on 15 March 2022, when a rape complaint was registered at the Navalsig Police Station. The 11-year-old victim disclosed that she had been raped in an open field during December 2021 while visiting her paternal grandfather.

The investigation was led by Detective Warrant Officer Arlene Snyman of the Parkweg Family Violence, Child Protection, and Sexual Offences (FCS) Unit, in collaboration with Advocate Ronel Botha from the National Prosecuting Authority (NPA).

According to police details, the investigation revealed that the grandfather’s wife, a 44-year-old professional educator, was aware that her 15-year-old son had allegedly raped the victim. Instead of reporting the incident to the authorities or the victim’s parents as mandated by law, the accused took the victim to a local pharmacy to purchase “morning-after” pills in an attempt to prevent pregnancy.

The educator was arrested on 31 August 2022. While the case against the 15-year-old son was subsequently withdrawn, the mother was prosecuted for her failure to report the sexual offence as required by her legal duty.

The court found the accused guilty of contravening Section 54 (1) (b) of the Sexual Offences and Related Matters Act (Act 32 of 2007), which mandates the reporting of sexual crimes committed against children. She was sentenced in terms of Section 276 (1) (b) of the Criminal Procedure Act (Act 51 of 1977) to three years’ imprisonment. The sentence was wholly suspended for five years on condition that she is not convicted of a similar offence during the period of suspension.
